Terms of Service

Effective 3 October 2026.

These Terms govern your use of the SerpKite API at api.serpkite.com, the dashboard at app.serpkite.com and the website at serpkite.com (together, the "Service"). The Service is provided by Anastasia Klimova, trading as SerpKite, 1732 Oberon Crescent, Mississauga, Ontario L4X 2K8, Canada ("SerpKite", "we", "us"). By creating an account or using an API key you agree to these Terms. If you use the Service on behalf of an organization, you confirm you may bind it, and "you" means that organization.

1. The Service

SerpKite returns publicly available search engine results pages, parsed into structured data (JSON) or text (Markdown), and related features such as fetching public web pages. We collect logged-out public results only, as described in How we collect data. We may add, change or remove features. We will give at least 30 days' notice by email or on the changelog before removing an API endpoint or making a breaking change to a versioned API, unless a change is required by law, by a third party we depend on, or to protect the Service.

Search engines change their pages without notice. We work to keep parsing accurate, but results may occasionally be incomplete or unavailable. Such requests are not billed (see section 4).

2. Accounts

  • You must be at least 18 and able to form a binding contract.
  • Provide a valid email address and keep it current. We use it for security, billing and service notices.
  • One person or organization per account. Creating multiple accounts to obtain additional free credits is prohibited.
  • You're responsible for all activity under your account and API keys.

3. API keys

API keys (skt_live_…) are secrets. Keep them out of client-side code and public repositories, and rotate a key immediately if you suspect it's exposed. We store only a hash of each key and cannot recover it. Usage made with your key before you revoke it is billed to you. You can limit exposure with per-key monthly credit limits and an account spend cap.

4. Credits, payments and refunds

  • Credits. Requests consume credits according to the credit table on the pricing page and in the API reference. The credits charged for each request are returned in the X-Credits-Used response header.
  • No expiry. Purchased credits do not expire while your account is open.
  • Not billed. Requests that fail upstream, time out, are blocked, or return an empty results page are refunded automatically.
  • Free credits. Signup, account-linking and monthly free credits are promotional, have no cash value, may be changed prospectively, and may be withdrawn in cases of abuse.
  • Payments. Credit packs are sold by our merchant of record, Paddle, which processes payment, issues invoices and handles sales tax and VAT. Paddle's buyer terms also apply to your purchase. Enterprise customers may be invoiced under a separate order form.
  • Refunds. Free credits are not refundable. If you bought a pack by mistake and haven't used any of its credits, email [email protected] with the order ID within 14 days and we'll refund it through Paddle. Partly used packs are not refundable, except where these Terms or the DPA provide a refund of unused prepaid credits or the law requires one. Refunded credits are removed from your balance. Details are in the Refund Policy.
  • Chargebacks. We may suspend an account while a chargeback is open.
  • Closing your account. Unused purchased credits are forfeited when you delete your account, so use or request a refund first.

5. Acceptable use

Your use must comply with the Acceptable Use Policy, which is part of these Terms. In short: no resale of the raw Service, no multi-accounting, no unlawful use, and no attempts to use SerpKite to access content behind a login. We may apply rate limits described in the documentation, and may ask high-volume accounts to verify their identity and use case as described in the Acceptable Use Policy.

6. Your data and results

  • Your queries. You own the queries you send. We process them only to provide the Service. We never log query text; results are cached briefly under a hashed key and batch results are kept for 24 hours, as described in the Privacy Policy.
  • Results. Results reflect third-party content (titles, snippets, links, image URLs). We don't grant you any rights in that content beyond what the law allows. You are responsible for how you use, store and publish results, including any personal data or copyrighted material they contain.
  • Personal data. Where we process personal data on your behalf, the Data Processing Addendum applies.
  • Feedback. If you send us suggestions, we may use them without obligation to you.

7. Our intellectual property

The Service, documentation, SDKs and brand are ours or our licensors'. SDKs and example code we publish under an open-source license are governed by that license. You may use the SerpKite name to describe your integration factually, but not in a way that suggests endorsement.

8. Availability and support

We publish live status and latency at status.serpkite.com. Self-serve plans have no uptime guarantee. A contractual SLA is available on enterprise plans under a separate agreement.

9. Suspension and termination

You can stop using the Service and delete your account at any time from the dashboard. We may suspend or terminate access if you breach these Terms or the Acceptable Use Policy, if your use creates security or legal risk for us or others, or if required by law. Where practical we'll notify you first and give you a chance to fix the issue. Sections 4 (as to amounts owed), 6, 7, 10, 11 and 13 survive termination.

10. Disclaimers

The Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that results are accurate, complete or uninterrupted. We are not affiliated with Google or any other search engine.

11. Limitation of liability

To the extent permitted by law, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability arising out of these Terms in any 12-month period is limited to the amount you paid us in that period. Nothing limits liability that cannot be limited by law.

12. Indemnity

You will defend and indemnify us against third-party claims arising from your use of results or your breach of these Terms or the Acceptable Use Policy. We do not currently provide an indemnity for the Service's collection method; see How we collect data.

13. General

  • Changes. We may update these Terms. Material changes take effect 30 days after notice by email; continued use after that means you accept them.
  • Governing law. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction. If you are a consumer, you keep the protection of the mandatory laws and courts of your country of residence.
  • Assignment. You may not assign these Terms without our consent; we may assign them in a merger, acquisition or sale of assets.
  • Entire agreement. These Terms, the policies they reference and any order form are the entire agreement between us.
